Law Professor Michael Oswalt was quoted in the article, “NLRB Joint Employer Shift No Silver Bullet For McDonald’s,” supporting charges filed against McDonald’s and a number of its franchisees as “joint employers” of workers allegedly retaliated against after striking for higher wages and better working conditions. Although the National Labor Relations Board recently changed the standard for determining joint employment, Oswalt stated that the evidence of immense control exercised by McDonald’s over its franchisees meant the case was strong under both the old and new standards.
